Are your property rights in danger after BC court’s Cowichan title ruling?

A landmark court ruling in British Columbia regarding Aboriginal land title over urban lands ignited fierce debate and uncertainty over the future of private property rights in the province and across the country.

The ruling concluded that the Cowichan Tribes held Aboriginal title to a part of their lands while Crown and city titles on the land are “defective and invalid,” and the granting of private titles on it by the government unjustifiably infringed on the Cowichan title.

One of the B.C. government’s lead treaty negotiators in the 1990’s, Thomas Isaac, spoke with Global News’ Jordan Armstrong about his assessment of the BC Supreme Court’s ruling and explained its repercussions.

"It’s not helpful to reconciliation. The decision is a direct statement on eroding indefeasible title in British Columbia," Isaac said.
