During question period on Tuesday, Conservative MP Frank Caputo criticized the Liberals for rejecting calls to use the Charter’s notwithstanding clause to overturn the Supreme Court’s ruling that struck down mandatory sentences for possession of child sexual abuse and exploitation materials.
"If the minister has ruled out using the notwithstanding clause, what’s his plan to take sex offenders off our streets?" Caputo said.
"Child abusers should face the toughest penalties under Canadian law. That is why we introduced do C-14… that make bail stricter, that Make sentences tougher and that makes sure that child abusers stay behind bars," Liberal Secretary of State Ruby Sahota responded.
The Constitution’s notwithstanding clause gives provincial legislatures or Parliament the ability to pass legislation that effectively overrides provisions of the Charter for a five-year period.
