Conservative Leader Pierre Poilievre rose in the House of Commons during question period on Tuesday, alleging Prime Minister Mark Carney’s government was working against B.C. property owners.
“The prime minister likes to spread the illusion that he’s protecting property rights, but the reality is quite the contrary. This Liberal government instructed its lawyers not to defend property rights in the Cowichan case with litigation directive No. 14, that said those titles don’t take priority,” Poilievre said.
Carney struck down the assertion saying “private property rights are fundamental in this country, this government will always defend them. That is why we immediately appealed the Cowichan decision.”
“In litigation Directive No. 14, it said that lawyers are not to make the case that fee simple property ownership takes precedence over all other claims. That directive is still on the government website, meaning that in all the litigation that is coming up on property ownership, this prime minister is directing his lawyers not to do their jobs and not to defend British Columbia homeowners. Why?” Poilievre asked.
Carney disagreed, saying “We have always defended private property rights. We always will and we will always defend the rights of Indigenous peoples to build Canada that’s stronger, fairer and more independent.”
B.C.’s Supreme Court decided last year that the Cowichan Nation has title over a portion of southeast Richmond. The federal and provincial governments are appealing the B.C. Supreme Court’s ruling in favour of the Quw’utsun Nation, or Cowichan Nation, that found it had “established Aboriginal title” to more than 5.7 square kilometres of land on the Fraser River in Richmond, south of Vancouver.
