One week before returning from maternity leave, Celia Johnston received a call from her employer that her job had been cut due to the company’s financial performance. Johnston quickly applied for employment insurance but was denied because while on maternity leave she wasn’t accumulating any insurable hours.
“You know you’ve been off work for an entire year, which is a big gap on your resume,” Johnston elaborated, “they reduced your income by 50 per cent while on maternity leave, so you already have less money coming in to begin with.”
Non-profit organization Mouvement Action Chomage Montreal has taken legal action on Johnston’s behalf. The case is now before the Federal Court of Appeal and it could take years before a decision is rendered.
